2017’s proposed S. 1460 would have reformed the hydropower licensing and permitting program by statutorily designating FERC as the lead agency, for purposes of NEPA review, for all licenses and permits required under federal law, and require FERC to set a centralized permitting schedule. It would have also put in place mechanisms to allow agencies that have parallel decision-making authority over a project to cooperate in their reviews without violating ex parte communications principles. It would also have allowed reviewing agencies to receive direct funding from hydropower licensing applicants.
