Clean Air Act §213 grants EPA the power to regulate nonroad vehicle sources, which includes any type of mobile source that was not designed primarily for highway travel. EPA must regulate emissions of CO, NOx, and VOCs, and may also regulate pollutants that “significantly contribute to air pollution.” Since many non-road vehicle burn diesel fuel, they are an important source of PM-2.5 and black carbon.
