In 2011, HB 259 directed CO2 storage operators to make good faith attempts to acquire the rights to pore space needed for long-term storage from the owners. If a storage operator has made good faith efforts and secured 51 percent of the interest in a pore space, the Kentucky Department for Natural Resources’ Division of Oil and Gas may order the pooling of the entire pore space to enable its use for CO2 storage. Compensation must be provided to all pore space owners, including those who did not consent.
