New Jersey’s A3723/S2314 (2018) mandates the creation of the Community Solar Energy Pilot Program. The New Jersey Board of Public Utilities adopted rules establishing the Community Solar Energy Pilot Program on January 17, 2019. The program has been lauded for strong provisions prioritizing low and moderate income customer participation.
Under program rules, 40 percent of the pilot program’s capacity is reserved for projects in which at least 51 percent of the capacity serves LMI communities. In the first year of the pilot, however, 100 percent of the 45 approved renewable energy projects promised to serve the requisite number of LMI customers, a celebrated overshoot.
