New York’s Article 10 of the Public Service Law gives the state’s “Siting Board considerable authority to override local laws that are ‘unreasonably burdensome,’ though that phrase has not yet been construed by the courts.”
In New York’s 2021 Budget, the state passed the Accelerated Renewable Energy Growth and Community Benefits Act (listed elsewhere under this section), which creates a new statewide Office for approving renewable energy facilities over 25 MW, and supplants the established approval processes under this section of the law.
