In 2009, SB 2139 prohibited surface property owners from severing title to the subsurface pore space, although the surface owner may lease the pore space. In 2009, SB 2095 established permit requirements for carbon dioxide geologic storage operators. Prior to issuing a permit, the North Dakota Industrial Commission must find that the storage operator made a good-faith effort to get the consent of all people who own the storage reservoir’s pore space; that the storage operator actually obtained the consent of at least 60 percent of the owners; and that non-consenting pore space owners are or will be equitably compensated. The commission may amalgamate property interests in the pore space.
