ORS §469.501(1) empowers the Energy Facility Siting Council to adopt standards for the siting, construction, operation and retirement of facilities. For energy facilities that emit carbon dioxide, the impacts of those emissions on climate change must be addressed in these standards. ORS §469.501(1)(o) requires that for fossil-fueled power plants, the council must apply a standard as provided for by ORS 469.503(2). Section 503 states that base load gas plants may not exceed 0.70 pounds of carbon dioxide emissions per kilowatt hour of net electric power output. The council may weigh a number of economic and technical factors in setting carbon dioxide emissions standards for other types of fossil-fueled power plants.
