The proposed American Clean Energy and Security Act of 2009 (“Waxman-Markey”) would have included a form of border carbon adjustment at Section 401 of Part IV of the bill. The proposed adjustment measured the national greenhouse gas intensity rate in covered countries for a category of covered goods, and applied an economic adjustment ratio to imports.
