The purpose of this Model Statute is to suggest a path forward for individuals and communities to access their courts to challenge government action or inaction on climate change. The Model Statute, if adopted in part or in whole, would assist those impacted by climate change to ask their courts to examine the efforts by their government to address climate change, and, if deemed appropriate by the courts under the relevant national or subnational law, to require the government to initiate or take further action. The focus here is on process against governments that may be lying dormant or failing to enforce climate change laws that have been enacted. The Model Statute seeks to provide a pathway for judicial intervention to assess government response to climate change under applicable laws and, if legally mandated, compel governments to take appropriate action.
