Chapter 111 of the Texas Code authorizes owners and operators of CO2 pipelines to have common carrier status if they consent in writing to being subject to the common carrier requirements. These requirements include the responsibility to publish tariffs and to charge equal fees for like service. As common carriers, CO2 pipeline owners and operator may exercise eminent domain authority to acquire any land, rights-of-way, easements and property necessary for pipeline construction and operation.
