In 2008, HB 89 clarified that the ownership of the pore space is vested in the owners of the surface land. Surface owner may sever ownership of pore space. In 2009, HB 80 established a process for unitization, or pooling, of geologic sequestration sites. An applicant must submit a copy of a permit allowing geologic sequestration to the Wyoming Oil and Gas Conservation Commission, as well as a proposed unitization plan. After a public hearing, the commission may approve the unitization plan if 80 percent of the pore space owners have provided their written consent. In some circumstances, the commission may also authorize unitization with the consent of parties owning 75 percent of the pore space. In 2008, HB 90 established that while Wyoming Oil and Gas Conservation Commission regulates the injection of carbon dioxide for enhanced oil recovery or for recovery of other minerals, the Wyoming Department of Environmental Quality oversees geologic sequestration of carbon for other purposes.
